Back Injury Form Work Incident

Sep 10, 2013 | Workers' Compensation

Back and neck injuries resulting from car accidents, slip and falls and other workplace injuries can be debilitating.  While most employees who suffer back and neck injuries on the job are generally entitled to workers’ compensation, proving these types of injuries can be challenging.

Certain types of neck and back injuries, such as a bone fracture, a slipped or herniated disc, or a spinal cord injury, can be substantiated by x-rays.  However, the majority of neck and back injuries result in muscle strains, ligament tears, nerve damage, sciatica, compression fractures and whiplash – all of which may not be able to be substantiated with anything other than the patient’s complaints of pain.

Although that pain may be very real, trying to obtain workers’ compensation benefits without conclusive proof can be an uphill battle.

At Geoff McDonald & Associates, we make it our job to understand your individual needs and circumstances, and our attorneys will fight to get you the money you deserve for lost wages, medical costs and fees, vocational rehabilitation or retraining.  We know the WC system and we’ll guide you through it to obtain the maximum workers’ compensation and other benefits for which you’re eligible. We’ll also make sure you’re fully informed and educated about your case at every step along the way.

Work-Related Back Injuries

Back disorders occur when workers exceed the capability of their muscles, tendons or discs.

Workers may wind up with back injuries because of the combined effect of these factors:

  • Reaching while lifting.
  • Poor posture.
  • Staying in one position for too long.
  • Bad positioning while lifting, pushing, pulling, or carrying objects.
  • Poor physical conditioning that leads to strains.
  • Poor design of the work space.
  • Repetitive lifting of items or equipment.
  • Twisting while lifting.
  • Bending while lifting.
  • Maintaining bent postures.
  • Heavy lifting or lifting with a forceful movement.
  • Fatigue.
  • Poor footing on slippery floors.
  • Vibration caused by lift trucks or delivery trucks.

Whiplash Injuries

Some neck and back injuries are caused by whiplash – a traumatic event which causes the head to move suddenly (or “whip”) in one direction and then recoil in the other direction.  Whiplash injuries can affect ligaments, discs, and joints – causing strained muscles and ligaments to become inflamed, painful, and tender.

Whiplash injury victims can also experience:

  • Headaches
  • Pain in the shoulders and between the shoulder blades
  • Pain in one or both arms.
  • Dizziness
  • Fatigue
  • Vision problems with vision
  • Ringing in the ears
  • Heaviness in the arms
  • Lower back pain.

While most people recover from whiplash within a few months, some people may never fully recover – especially if they have already suffered a neck or back injury, are elderly or have other medical issues that might affect their condition.  These conditions can lead to substantial medical costs, rehabilitation, lost income, job retraining, pain and suffering and put a financial burden on you and your family to pay your bills and make ends meet.
